Terms & Conditions of Participation
In consideration of being allowed to participate in any way, in any S3 Leagues (“S3”) event, program or activity (collectively “Programs”), I understand, acknowledge, appreciate and agree that:
The risks of injury and risk from the activities involved in these Programs are significant, including the potential for death, bodily injury, sickness and disease, permanent disability, loss of or damage to equipment or property, exposure to collision, vehicles, or natural or manmade objects, dangers arising from adverse weather conditions, imperfect conditions on the property where the Programs are taking place, equipment failure, inadequate safety measures, participants of varying skill levels, situations beyond immediate control of the organizers or S3, and other undefined risks and dangers which may not be readily foreseeable or are presently unknown (the “Risks”). I knowingly and freely assume all such Risks, both known and unknown, even if arising from the negligence of S3 and assume full responsibility for my participation; and I willingly agree to comply with the stated and customary terms and conditions for participation, including any rules provided by S3 for participation in the Programs.
I hereby represent that I am in good health and in proper physical condition to participate in the Programs and I am not under the influence of alcohol or any illicit or prescription drugs which would impair my ability to safety participate in the Programs.
I have inspected or will immediately inspect the facilities and equipment to be used in conjunction with the Programs and if I believe any unsafe condition exists, I will immediately advise S3 of such condition and will refuse participation until such condition is corrected; I further consent to the use of my image or likeness in promotional material to be used by S3, it’s associates, and the general media. I freely and willingly waive all rights and claims to compensation for use of my image or likeness.
For a period of two (2) years following the date of my last participation in any Program, I shall not, directly or indirectly, develop, create, establish or participate in the development, creation or establishment of any organization, league or other entity that engages in events, programs and activities competitive with S3’s Programs.
I agree to be familiar with and abide by any rules or regulations established for the Program in which I participate. I also accept sole responsibility for my own conduct and actions while participating in these Programs and the condition and adequacy of any equipment that I might own, use, or supply in conjunction with the Program.
I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, DEFEND AND HOLD HARMLESS S3, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, shareholders, volunteers, and if applicable owners and lessors of premises used for the Programs (“Releasees”), with RESPECT TO ANY AND ALL LIABILITY, CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, INJURY, DISABILITY, DEATH, LOSS OR DAMAGE TO PERSON OR PROPERTY ASSOCIATED WITH MY PRESENCE OR PARTICIPATION, OTHER LOSSES AND EXPENSES INCLUDING COURT COSTS AND REASONABLE ATTORNEY’S FEES OF ANY KIND OR NATURE WHICH MAY ARISE OUT OF OR RELATE TO MY PARTICIPATION IN THE PROGRAM.
This voluntary liability waiver form shall be in full force and effect at all times during my participation in the Programs, of any kind or nature, and for whatever period of time I participate in said Programs, either continuously or from time to time, as the case may be. This Agreement shall be interpreted, construed, and governed according to the laws of the State of Illinois.
I HAVE READ THIS VOLUNTARY LIABILITY WAIVER, FULLY UNDERSTAND ITS TERMS AND CONDITIONS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY REGISTERING FOR A LEAGUE AND AGREE TO THESE TERMS & CONDITIONS, AND DO SO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. THIS AGREEMENT REPRESENTS THE COMPLETE UNDERSTANDING BETWEEN THE PARTIES REGARDING THESE ISSUES AND NO ORAL REPRESENTATION, STATEMENTS, OR INDUCEMENTS HAVE BEEN MADE APART FROM THIS AGREEMENT. IF ANY PROVISION OF THIS AGREEMENT IS TO BE HELD UNLAWFUL, VOID OR FOR ANY REASON UNENFORCEABLE, THEN THAT PROVISION SHALL BE DEEMED SEVERABLE FROM THIS AGREEMENT AND SHALL NOT AFFECT THE VALIDITY OF ANY REMAINING PROVISIONS.
This Code of Conduct is agreed to by registering for a league. It reads:
– I have read this Code of Conduct and hereby agree to adhere to it or forfeit my league fee and the remainder of my league’s season as well as any amount of future leagues and events.
– I will not engage in unsportsmanlike conduct with any player, participant, official or any other attendee.
– I will not impede the progression of a game for any reason.
– I will not engage in any behavior which would endanger the health, safety or well being of any player, participant, official or any other attendee, including myself.
– I will not play under the influence of drugs or alcohol.
– I will treat any player, participant, official or any other attendee with respect regardless of race, creed, color, national origin, ability, sex or sexual orientation.
– I will not engage in verbal or physical threats or abuse aimed at any player, participant, official or any other attendee.
– I will not initiate a fight or scuffle with any player, participant, official or any other attendee.
– If I violate the S3 Player Code of Conduct, punishment may include but not be limited to same day game ejection, suspension from future games, removal from entire season or being banned from future league participation.
– I will participate in mediation with an open mind if any situation arises that I am involved in and attempt to move forward from a problem. If a solution cannot be achieved through mediation, I may be removed from the league without refund to ensure the well being and cohesiveness of the team.
– S3 reserves the right to refuse service to anyone.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.
S3 Leagues, Inc. (hereafter known as “S3”) cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while utilizing S3 services and related activities. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize S3 services and/or participate in S3 games at the physical location and/or attend the league sponsor bar you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
I affirm that I am in good health and in proper physical condition to participate in S3 games and activities. I will not attend if I have been diagnosed positive for Covid-19 and/or am showing symptoms of Covid-19. I will inform S3 management if I have tested positive for Covid-19. I agree that it is my sole responsibility to determine whether I am sufficiently healthy enough and free from Covid-19 to participate in S3 activities.
I acknowledge that I have read in its entirety the Covid-19 Preventative Measures at Games & Guidelines for Participation posted on the S3 Leagues website and will follow these guidelines.
ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself in order to utilize S3 services and/or participate in S3 games at the game location and/or attend the league sponsor bar. These services are of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize S3 services and related activities in person.
WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against S3 and its owners, officers, directors, managers, officials, trustees, agents, employees, umpires, league coordinators, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing S3 services. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
CHOICE OF LAW: I understand and agree that the law of the State of Illinois will apply to this contract.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.
While we can provide refunds in certain situations for many events, if the event page says “no refunds” then that is a no refunds event and we can not provide refunds for any reason at all. Refunds for other events can be issued in full if you email info@s3leagues.com and state your desire for a refund more than 48 hours in advance of the scheduled event date and start time. This is a very fair refund policy compared to what most other events organizations offer. Within 48 hours of the event, refunds cannot be given for any reason but your spot/ticket can be transferred to another person if you provide us with the person’s name, email and any other info required to transfer the spot/ticket to.
This policy is based on reasons including but not limited to plans made based on the number of participants for each event, updating website to reflect ticket sales numbers and sold out quantities, etc. Therefore, it’s not possible to provide refunds for any event within this 48hour time period. In addition, refunds will not be given after the event has occurred or passed for any reason, whether you were able to attend or not. Because we want all of our events sold out when we say they’re sold out since there’s a specific set amount of space for each event, sometimes we are able to find people to replace you. If your event is in one of these situations we will let you know if we were able to find a replacement and can then refund you, but this should not be expected in any case even though we will occasionally be able to do this.
